Fruit Picking Business Fined $12,000

Australia, -- A Queensland fruit picking business has been fined $12,000 in the Brisbane Industrial Magistrates' Court for an incident involving a British backpacker being seriously injured after falling from a work platform.

Donovan Family Investments Pty Ltd pleaded guilty to a breach of Section 28(1) of the Workpalce Health and Safety Act 1995 QLD for failing to ensure the health and safety of workers.

The Department of Employment, Training and Industrial Relations' Division of Workplace Health and Safety instigated the prosecution after a worker sustained grievous bodily injury from falling 4.6 metres in April 1999.

The injured worker was picking avocados on a property at Alloway, via Bundaberg.

The court was told there was no fall protection in place and the worker had received inadequate information, instruction, training and supervision.

In imposing the $12,000 fine, Magistrate Ken Taylor said the safety information provided by the employer had been grossly inadequate and the penalty reflected the seriousness of the breach. Legal and investigation costs of $4,250 were also imposed on the company.
